1. Introduction and Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "User," "you," or "your") and Elegance Store, operated by Luxury Brands (עוסק מורשה), Business ID 200854792 ("Elegance Store," "Company," "we," "us," or "our"), an Israeli licensed dealer / sole proprietorship (עוסק מורשה).
These Terms govern your access to and use of the Elegance Store website located at elegancestore-production.up.railway.app (the "Website" or "Platform"), including any purchase of products, creation of a user account, and any other interaction with our services (collectively, the "Services").
By accessing, browsing, or using the Website, by creating an account, or by placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to any provision of these Terms, you must refrain from using the Website and the Services.
These Terms are drafted in compliance with Israeli law, including but not limited to the Consumer Protection Law, 5741-1981 (חוק הגנת הצרכן, תשמ"א-1981), the Contracts Law (General Part), 5733-1973 (חוק החוזים (חלק כללי), תשל"ג-1973), and the Sale Law (Sale of Goods), 5728-1968 (חוק המכר, תשכ"ח-1968).
This agreement constitutes a "distance sale" (עסקת מכר מרחוק) within the meaning of Section 14G of the Consumer Protection Law, and all applicable rights and obligations pertaining to distance sales shall apply.
2. Definitions
In these Terms, unless the context requires otherwise:
- "Account" means the personal user account created by a User on the Website through the registration process, including email verification.
- "Business Days" means Sunday through Thursday, 10:00-19:00, and Friday, 10:00-14:00 (Israel Standard Time), excluding Israeli public holidays and Shabbat (Saturday).
- "Consumer Protection Law" means the Israeli Consumer Protection Law, 5741-1981 (חוק הגנת הצרכן, תשמ"א-1981), as amended from time to time.
- "Cancellation Regulations" means the Consumer Protection Regulations (Cancellation of Transaction), 5771-2010 (תקנות הגנת הצרכן (ביטול עסקה), תשע"א-2010).
- "Down Payment" means the initial payment made by the Customer at the time of placing an Order, as described in Section 7.
- "Order" means a request submitted by the Customer through the Website to purchase one or more Products, which becomes binding upon acceptance by the Company.
- "Products" means any designer fashion items offered for sale on the Website, including but not limited to clothing, shoes, bags, and accessories from brands such as Tommy Hilfiger, Lacoste, Calvin Klein, Michael Kors, and other designers as may be available from time to time.
- "Supplier" means any third-party authorized retailer or distributor from whom the Company sources Products internationally on behalf of the Customer.
- "ILS" or "₪" means Israeli New Shekel, the lawful currency of the State of Israel.
- "VAT" means Value Added Tax as applicable under Israeli law, currently at the rate of 18%.
3. Eligibility
3.1 Age Requirement
The Services are intended for individuals who are eighteen (18) years of age or older. If you are under the age of 18, you may use the Website only with the involvement, consent, and supervision of a parent or legal guardian. By using the Website, you represent and warrant that you are at least 18 years old, or that you have obtained valid parental or guardian consent to use the Website and enter into this agreement.
3.2 Geographic Scope
The Services are primarily offered to residents of the State of Israel. Orders may only be shipped to addresses within the State of Israel. The Company reserves the right to refuse service or cancel orders placed from or destined for addresses outside Israel.
3.3 Legal Capacity
By placing an Order, you represent that you have the legal capacity to enter into a binding contract under Israeli law, as defined in the Legal Capacity and Guardianship Law, 5722-1962 (חוק הכשרות המשפטית והאפוטרופסות, תשכ"ב-1962).
4. Account Registration and Security
4.1 Registration Requirements
To place Orders on the Website, you must create an Account. Account creation requires you to provide accurate, current, and complete information, including a valid email address. You must verify your email address through the verification link sent to the email address you provide during registration.
4.2 Account Accuracy
You are responsible for maintaining the accuracy and completeness of all information associated with your Account. You agree to promptly update your Account information if any changes occur.
4.3 Account Security
You are solely responsible for safeguarding the confidentiality of your Account credentials, including your password. You agree to notify us immediately at ameerdow@icloud.com if you become aware of any unauthorized use of your Account or any breach of security. The Company shall not be liable for any loss or damage arising from your failure to protect your Account credentials.
4.4 Account Termination
The Company reserves the right to suspend or terminate your Account at any time, with or without notice, if we reasonably believe that: (a) you have violated these Terms; (b) you have provided false or misleading information; (c) your Account has been used for fraudulent or illegal activity; or (d) continued use of your Account poses a risk to the Company or other Users.
5. Products and Pricing
5.1 Product Descriptions
The Company makes every reasonable effort to display Products accurately on the Website, including descriptions, images, colors, sizes, and materials. However, Product images are for illustrative purposes, and actual Products may vary slightly in color, texture, or appearance due to differences in screen settings, photography, and manufacturing variations. Such minor variations shall not constitute a defect or non-conformity.
5.2 Pricing
All prices displayed on the Website are quoted in Israeli New Shekels (ILS / ₪) and are inclusive of Value Added Tax (VAT) at the applicable rate (currently 18%), in compliance with Section 17B of the Consumer Protection Law and the Consumer Protection Regulations (Method of Price Indication on Goods and Services), 5751-1991 (תקנות הגנת הצרכן (דרך סימון מחירים), תשנ"א-1991).
5.3 Price Changes
The Company reserves the right to modify Product prices at any time without prior notice. However, once an Order has been accepted by the Company, the price for that Order shall not be changed except as expressly permitted by these Terms or applicable law. In the event of a manifest pricing error on the Website, the Company may, at its discretion, cancel the Order and notify the Customer, in which case any payment made will be refunded in full.
5.4 Authenticity Guarantee
Elegance Store provides a 100% Authenticity Guarantee on all Products. All Products sold through the Website are genuine, authentic, brand-name items sourced from authorized suppliers and retailers. The Company does not sell counterfeit, imitation, or "knock-off" merchandise. If a Product is found to be inauthentic, the Customer shall be entitled to a full refund and return at the Company's expense.
5.5 Product Availability
Product availability is subject to change without notice. The listing of a Product on the Website does not guarantee that it is currently in stock or available for purchase, as Products are sourced from international suppliers (see Section 6). The Company reserves the right to limit the quantity of any Product sold to any Customer.
6. Ordering Process
6.1 Business Model
The Customer acknowledges and agrees that Elegance Store operates on an international sourcing model. Products displayed on the Website are not held in local inventory. Instead, upon receipt and acceptance of the Customer's Order and payment (or Down Payment, as applicable), the Company will procure the ordered Products from international Suppliers on the Customer's behalf. This model enables us to offer authentic designer products at competitive prices.
6.2 Order Placement
To place an Order, the Customer must: (a) select the desired Product(s), including size and color where applicable; (b) add the Product(s) to the shopping cart; (c) proceed to checkout; (d) provide a valid shipping address within Israel; (e) provide accurate contact information (email and phone number); (f) select a payment method; (g) accept these Terms and our Privacy Policy; and (h) submit the Order.
6.3 Order Acceptance
Submission of an Order constitutes an offer to purchase the Products. An Order is not deemed accepted until: (a) the Company has confirmed receipt of the Order; and (b) the Company has verified receipt of payment (or Down Payment). The Company reserves the right to reject any Order at its sole discretion, including but not limited to cases where the Product is unavailable, a pricing error has occurred, or the Customer's identity cannot be verified.
6.4 Order Tracking
Once an Order is accepted, the Customer may track its progress through the following statuses visible on their Account:
- Pending — Order received, awaiting payment confirmation.
- Ordered — Product ordered from the international Supplier.
- Shipped — Product has been shipped and is in transit to you.
- Delivered — Product has been delivered to your specified address.
Detailed status updates may be available within your Account dashboard. The Company will make commercially reasonable efforts to notify you of material changes in your Order status.
6.5 Order Modifications
Requests to modify an Order (including changes to size, color, quantity, or shipping address) must be submitted to ameerdow@icloud.com during Business Days. Modifications are subject to availability and may not be possible once the Product has been ordered from the Supplier. The Company shall use reasonable efforts to accommodate modification requests but does not guarantee that modifications can be made.
7. Payment Terms
7.1 Accepted Payment Methods
The Company accepts the following payment methods:
- BIT — Payment via the BIT mobile payment application. Payment details and recipient information will be provided upon order confirmation.
- Bank Transfer — Direct transfer to the Company's bank account at Bank Leumi. Full account details will be provided upon order confirmation.
- Cash on Delivery (COD) — Payment in cash upon delivery of the Product(s). Cash on Delivery is available only for the remaining balance after the Down Payment has been made, where applicable.
The Company does not currently accept credit card payments. All payments are processed manually. The Customer is responsible for ensuring that payment is made promptly and accurately in accordance with the instructions provided.
7.2 Down Payment Policy
The following payment structure applies:
- Orders under ₪1,000: Full payment is required at the time of placing the Order. The Order will not be processed until full payment is received and confirmed.
- Orders of ₪1,000 or more: A minimum Down Payment of ₪1,000 is required at the time of placing the Order. The remaining balance is due upon delivery or as otherwise agreed between the Customer and the Company.
The Customer may elect to pay the full Order amount at the time of purchase regardless of the Order value.
7.3 Payment Confirmation
As payments are processed manually, the Company requires reasonable time to verify and confirm receipt of payment. The Company will confirm payment within two (2) Business Days of receipt. The Order processing timeline commences upon payment confirmation. The Company is not responsible for delays caused by banking system processing times, incorrect payment details provided by the Customer, or technical issues with the BIT application.
7.4 Non-Payment
If the Customer fails to complete payment (or the Down Payment) within seven (7) calendar days of placing the Order, the Company reserves the right to cancel the Order without further notice. In the event of non-payment of the remaining balance upon delivery, the Company may withhold delivery and, at its discretion, cancel the Order. If the Order has already been procured from the Supplier and cannot be returned, the Company reserves the right to retain the Down Payment to cover procurement costs incurred.
7.5 Currency
All payments must be made in Israeli New Shekels (ILS / ₪). The Company shall not accept payments in foreign currencies.
8. Shipping and Delivery
8.1 Shipping Scope
The Company ships Products to addresses within the State of Israel only. The Company does not offer international shipping to end customers.
8.2 International Sourcing Timeline
Due to the international sourcing nature of our business model, delivery timelines are longer than standard domestic e-commerce. The typical delivery process involves the following stages:
- Order placed with international Supplier (1-3 Business Days after payment confirmation).
- Supplier ships Product to our designated warehouse (3-10 Business Days).
- Product received and processed at warehouse (1-3 Business Days).
- Product shipped from warehouse to Israel (5-14 Business Days).
- Product cleared through Israeli customs (1-5 Business Days).
- Product shipped to the Customer's address within Israel (2-5 Business Days).
Estimated total delivery time: 14-40 Business Days from payment confirmation. Delivery times are estimates only and are not guaranteed. Actual delivery times may vary due to factors outside the Company's control, including Supplier processing times, international shipping delays, customs clearance procedures, and domestic carrier schedules.
8.3 Shipping Costs
- Orders of ₪1,000 or more: Free shipping within Israel.
- Orders under ₪1,000: Shipping fees will be calculated and displayed at checkout based on the shipping destination and Order details.
8.4 Delivery Responsibility
Risk of loss and title to the Products shall pass to the Customer upon delivery to the shipping address specified in the Order. The Customer is responsible for providing a correct and complete shipping address. The Company shall not be liable for delays, loss, or damage caused by incorrect or incomplete address information provided by the Customer.
8.5 Delivery Attempts
If delivery cannot be completed due to the Customer's absence, refusal to accept the package, or other reasons attributable to the Customer, the Company will make reasonable efforts to arrange redelivery. Additional delivery charges may apply for redelivery attempts. If the Product cannot be delivered after reasonable attempts, the Company may return the Product and deduct return shipping costs from any refund due to the Customer.
9. Right of Cancellation Under Israeli Consumer Protection Law
9.1 Statutory Right of Cancellation
In accordance with the Consumer Protection Law, 5741-1981 (Sections 14G-14H) and the Consumer Protection Regulations (Cancellation of Transaction), 5771-2010 (תקנות הגנת הצרכן (ביטול עסקה), תשע"א-2010), the Customer has the right to cancel a distance sale transaction within fourteen (14) days from the date of receipt of the Product, or from the date of receiving the transaction confirmation document, whichever is later, as required under Section 14G(b) of the Consumer Protection Law.
9.2 How to Cancel
Cancellation may be effected by sending a written cancellation notice to our email address: ameerdow@icloud.com.
The cancellation notice must include the Customer's name, Israeli identity number (מספר זהות) or passport number, and Order number, as required under the Cancellation Regulations.
9.3 Cancellation Fees
In the event of a valid cancellation under this Section, the Company is entitled to charge a cancellation fee of up to 5% of the transaction price or ₪100, whichever is lower (דמי ביטול), as permitted under Section 14H(a) of the Consumer Protection Law.
9.4 Cancellation After Product Has Been Ordered from Supplier
Important Notice: The Customer acknowledges that due to the Company's international sourcing model, Products are ordered from Suppliers specifically in response to the Customer's Order. The statutory 14-day cancellation right applies as set forth in Section 9.1 above, irrespective of whether the Company has already ordered the Product from its Supplier. However, the Customer is advised that:
- Cancellation requests submitted before the Product has been ordered from the Supplier will generally be processed promptly with no additional charges beyond the statutory cancellation fee.
- Cancellation requests submitted after the Product has been ordered from the Supplier may result in the Company incurring costs that cannot be recovered. In such cases, the Company reserves its right to deduct reasonable and documented costs actually incurred in connection with the Order, to the extent permitted by law.
The Company encourages Customers to submit any cancellation requests as early as possible to minimize costs to both parties.
9.5 Exceptions to the Right of Cancellation
In accordance with Section 14G(d) of the Consumer Protection Law and Regulation 6 of the Cancellation Regulations, the right of cancellation shall not apply to:
- Products that have been used, worn, washed, altered, or damaged by the Customer.
- Products where the seal, tag, or packaging has been opened or removed, and the opening prevents the resale of the Product (e.g., intimate apparel, swimwear, earrings).
- Products that were custom-made or personalized to the Customer's specifications.
- Products that may deteriorate or expire rapidly.
9.6 Refund Upon Cancellation
Upon valid cancellation, the Company will refund the Customer within fourteen (14) days from the date of receipt of the cancellation notice, less the applicable cancellation fee specified in Section 9.3. The refund shall be made using the same payment method originally used by the Customer, or by bank transfer if the original payment method is not available. If the Product has already been delivered, the Customer must return the Product to the Company in its original condition, with all tags, labels, and packaging intact, at the Customer's expense, unless the cancellation is due to a defect or non-conformity of the Product.
9.7 Persons with Disabilities
In accordance with Section 14G1 of the Consumer Protection Law, a person with a disability, a senior citizen (above age 65), or a new immigrant (within five years of Aliyah) may cancel a distance sale transaction within four (4) months from the date of the transaction, the date of receiving the Product, or the date of receiving the transaction confirmation document, whichever is later, provided that the negotiation or the transaction was also conducted via telephone.
10. Returns and Exchanges
10.1 Scope of Returns
The Company does not offer a discretionary or goodwill return policy. Product returns and refunds are available exclusively pursuant to (a) the statutory cancellation right described in Section 9 above, or (b) Section 10.3 below (defective or non-conforming Products).
10.2 Exchange Process
Where a Customer wishes to exchange a Product (for example, for a different size), the Customer must contact us at ameerdow@icloud.com. Exchanges are offered subject to Product availability and do not constitute a statutory entitlement. If the requested replacement Product is not available, the Customer may cancel the original Order in accordance with Section 9 and place a new Order.
10.3 Defective or Non-Conforming Products
If a Product received by the Customer is defective, damaged, or materially different from the description on the Website, the Customer must notify the Company within a reasonable time of discovery of the defect, and in any event within the warranty period specified in Section 11. In such cases:
- The Customer shall be entitled to a full refund or replacement at the Company's expense.
- Return shipping costs for defective or non-conforming Products shall be borne by the Company.
- The statutory cancellation fee shall not apply.
10.4 Return Shipping
Unless the return is due to a defect, non-conformity, or an error by the Company, the Customer shall bear the cost of return shipping. Products must be shipped using a traceable shipping method, and the Customer is responsible for the Product until it is received by the Company.
11. Warranties and Liability Limitations
11.1 Statutory Warranty
Products sold by the Company are covered by the statutory warranty rights provided under the Sale Law (Sale of Goods), 5728-1968 (חוק המכר, תשכ"ח-1968), including the seller's obligation to deliver goods that conform to the description, are of merchantable quality, and are fit for their ordinary purpose.
11.2 Manufacturer Warranties
Certain Products may be covered by the original manufacturer's warranty. The terms and scope of such warranties are determined solely by the manufacturer and are not administered by the Company. The Company will make reasonable efforts to assist Customers in contacting the relevant manufacturer for warranty claims, but assumes no responsibility for the fulfillment of manufacturer warranties.
11.3 Limitation of Liability
To the maximum extent permitted by applicable law:
- The Company's total aggregate liability arising out of or in connection with any Order shall not exceed the total amount actually paid by the Customer for that specific Order.
- The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with the use of the Website, the Services, or the purchase of Products, even if the Company has been advised of the possibility of such damages.
- The Company shall not be liable for delays in delivery or unavailability of Products caused by circumstances beyond its reasonable control (see Section 11.5).
11.4 Disclaimer
The Website and its content are provided "as is" and "as available." The Company disclaims all warranties, express or implied, to the maximum extent permitted by law, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as mandated by Israeli consumer protection law. Nothing in these Terms shall limit or exclude any rights that you may have under applicable mandatory Israeli law that cannot be excluded or limited by contract.
11.5 Force Majeure
The Company shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by events or circumstances beyond the Company's reasonable control, including but not limited to: acts of God; natural disasters; pandemics or epidemics; war, terrorism, or armed conflict; government actions, sanctions, or embargoes; labor disputes or strikes; interruptions in transportation or supply chains; customs delays; port closures; carrier disruptions; failures of telecommunications or internet infrastructure; cyberattacks; or any other event constituting force majeure under Israeli law. In the event of a force majeure lasting more than sixty (60) days, either party may terminate the affected Order upon written notice, and the Customer shall be entitled to a full refund of all amounts paid for the undelivered Product(s).
12. Intellectual Property
12.1 Company Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, images, software, user interface designs, and the overall look and feel of the Website (collectively, "Company Content"), is the property of Luxury Brands or its licensors and is protected by Israeli and international copyright, trademark, and other intellectual property laws.
12.2 Third-Party Trademarks
Brand names, logos, and trademarks displayed on the Website (including but not limited to Tommy Hilfiger, Lacoste, Calvin Klein, and Michael Kors) are the property of their respective owners. The display of such trademarks on the Website does not imply any affiliation with, sponsorship by, or endorsement by the respective brand owners. Elegance Store is an independent retailer and is not an authorized representative, franchise, or subsidiary of any of the brands listed on the Website, unless expressly stated otherwise.
12.3 Restrictions
You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Company Content without the prior written consent of the Company. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website solely for personal, non-commercial purposes in connection with browsing and purchasing Products.
13. User Conduct and Prohibited Uses
By using the Website, you agree that you shall not:
- Use the Website for any unlawful, fraudulent, or malicious purpose.
- Provide false, misleading, or inaccurate information when creating an Account or placing an Order.
- Interfere with or disrupt the operation of the Website, servers, or networks connected to the Website.
- Attempt to gain unauthorized access to any portion of the Website, other user accounts, or any systems or networks connected to the Website.
- Use any automated means (including bots, scrapers, or spiders) to access, monitor, or copy any content from the Website without the Company's prior written consent.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity.
- Purchase Products for the purpose of commercial resale without the Company's prior written consent.
- Engage in any activity that could damage, disable, overburden, or impair the Website or interfere with any other party's use of the Website.
- Transmit any viruses, malware, or other harmful code through the Website.
The Company reserves the right to investigate and take appropriate legal action against anyone who violates this Section, including reporting such conduct to law enforcement authorities.
14. Privacy
Your privacy is important to us. The collection, use, storage, and processing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Website and the Services, you consent to the collection and use of your personal information as described in our Privacy Policy, in compliance with the Protection of Privacy Law, 5741-1981 (חוק הגנת הפרטיות, תשמ"א-1981) and the Privacy Protection Regulations (Data Security), 5777-2017 (תקנות הגנת הפרטיות (אבטחת מידע), תשע"ז-2017).

15. Dispute Resolution and Governing Law
15.1 Governing Law
These Terms, and any dispute, claim, or cause of action arising out of or in connection with these Terms, the Website, or the purchase of Products, shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of laws principles.
15.2 Exclusive Jurisdiction
Any dispute arising out of or in connection with these Terms, the Website, or any transaction conducted through the Website, that cannot be resolved amicably between the parties, shall be submitted to the exclusive jurisdiction of the competent courts located in Tel Aviv-Jaffa, Israel. The parties hereby irrevocably consent to the jurisdiction and venue of such courts for all such disputes.
15.3 Pre-Litigation Resolution
Before initiating any legal proceedings, the parties agree to attempt in good faith to resolve any dispute through direct negotiation. The Customer must first contact the Company at ameerdow@icloud.com with a detailed description of the dispute. The Company shall respond within fourteen (14) Business Days. The parties shall endeavor to reach a resolution within thirty (30) days from the date of the initial complaint.
15.4 Small Claims
Nothing in these Terms shall prevent or limit either party from filing a claim in the Small Claims Court (בית משפט לתביעות קטנות), where applicable and subject to the monetary jurisdiction of such court.
16. Amendments to Terms
The Company reserves the right to modify, amend, or update these Terms at any time at its sole discretion. Any material changes to these Terms will be posted on the Website with an updated "Last Updated" date. It is the Customer's responsibility to review these Terms periodically. Continued use of the Website following the posting of changes constitutes your acceptance of such changes. Changes to these Terms shall not apply retroactively to Orders placed before the effective date of the changes, unless required by law.
